The Texas Divorce Process & Timeline

|

When your marriage dissolves and a divorce is necessary, you will want to get the process completed as quickly as possible. However, as with most legal matters, there are standards that must be followed to ensure the divorce is completed correctly. If you have questions as to what the timeline for a Texas divorce is, here are some things to keep in mind.

60-Day Waiting Period for Divorce in Texas

First and foremost, there is a 60-day waiting period for any divorce that takes place in Texas to become final. Thus, if you and your spouse can work out a settlement on which both of you agree, your divorce will be granted on day 61. Should an agreement take longer than 60 days, the divorce is granted once the settlement is finalized.

Residency Requirements

Along with the 60-day waiting period, Texans seeking a divorce must also meet residency requirements. In most cases, this means you will need to have been a resident of Texas for at least six months and a resident of the county where you file for divorce for at least 90 days. Upon meeting these requirements, you are allowed to file for divorce and can be granted one upon the passing of the 60-day waiting period.

Expediting the Process

While generally, the Texas divorce timeline cannot be deviated from, it does allow for an exception when domestic violence is involved. In these cases, let your Woodlands divorce attorney aware of this immediately. Your divorce lawyer can notify the court and ask for a waiver of the 60-day waiting period.

Since the divorce process can be stressful and confusing, always work with legal advocates that specialize in this area of law.
